Financier Jaroslav Hascak has filed a lawsuit to claim compensation from the state for the criminal prosecution against him, based on charges pressed on December 1, 2020, which were dropped by the Prosecutor-General's Office as unlawful, TASR learnt from the Relevans legal office on Tuesday.
“Our client chose to sue once new findings came to light in recent months about steps taken by an investigator of the National Criminal Agency (NAKA)," said Relevans partner Alexander Kadela, who believes that the investigator pursued ulterior motives with the prosecution.
In Kadela's view, it is in the interest of the rule of law to have the lawsuit heard by an independent and impartial court. "The case can also serve as a warning about the extremely serious consequences that arise from unlawful interference with fundamental rights of citizens by the state power," added Kadela.
Hascak was originally charged with bribery and an aggravated crime of money laundering. The Prosecutor-General's Office decided to scrap the charges in late August 2021.
