The Slovak Republic won a long-running legal dispute against Dutch company Achmea B.V., a shareholder of Union Health Insurance, concerning a ban on profits for health insurers. The German Constitutional Court ruled in favor of Slovakia, rejecting Achmea's constitutional complaint, meaning Slovakia will not have to pay over EUR 22 million in compensation. This ruling also ends legal proceedings in Luxembourg, where EUR 30 million of Slovak funds had been blocked. Achmea had originally sued Slovakia in 2008, claiming the profit ban violated a bilateral investment agreement. However, in 2018, the European Court of Justice and the German Supreme Court ruled in Slovakia’s favor, overturning the original arbitration decision. The Ministry of Finance praised the outcome, noting Slovakia has successfully defended all related arbitration disputes.
