The Supreme Court's Criminal Law Collegium has clarified how actions interrupting the statute of limitations for criminal prosecution should be assessed under shortened limitation periods. Court spokesperson Alexandra Važanová explained that, under the Constitution and Criminal Code, the law more favorable to the offender must apply when determining criminality and sentencing. Interruptions of the statute of limitations under Section 87(3) of the Criminal Code only remain valid if the actions causing the interruption occurred within the shortened, more favorable limitation period. This rule does not apply to offenses listed in Section 87(7), which concern harm to the EU’s financial interests.
