The Bratislava Regional Court turned down the request by a prosecutor to take two police officers, Branislav Duncko and Robert Magula, into custody. The two police officers, previously involved in investigation of high-profile corruption cases, face charges of obstruction of justice. The prosecutor proposed to take the two men into so-called collusion custody over the fact they had a digital conversation among themselves. The defence doesn't perceive that as a reason to hold them in custody.
Duncko and Magula were charged by an investigator of the Internal Affairs Inspectorate with obstruction of justice and arrested, but later released by a pre-trial judge. The prosecutor appealed against the decision to have them released from custody. The police officers allegedly committed the crime during their tenure in the now defunct National Criminal Agency (NAKA). Their defence attorney considers the prosecution unjustified.
