87 MPs votes supported the motion to prevent legal transition. This would be made impossible through the amended Birth Number Act. In the case of a change of sex, the birth number should not be changed. This should only be possible in the event of incorrect sex determination. The amendment was proposed by MPs from the coalition Sme rodina and OLANO parties, and on Tuesday the plenary moved it to the second reading. According to the draft amendment, it would be possible to change a person's birth number in the event of an incorrect determination of a person's sex on the basis of a medical opinion, which is a confirmation of the genetic results of the determination of the actual biological sex.

If the amendment to the Birth Number Act is definitively passed, lawmakers of the SaS party plan to call on President Zuzana Caputova to veto it and will reach out to the Constitutional Court to suspend its effects temporarily. At a Wednesday press conference, the lawmakers urged the part of the public that takes an interest in transgender people and their transition to send their arguments to the party, which is gearing up to lodge a complaint with the Constitutional Court. According to former Justice Minister Maria Kolikova, the bill flies in the face of the Constitution. MP Jana Bitto Ciganikova (SaS) maintains that the amendment prevents the completion of the transition. For instance, it prevents people from changing their names (to reflect their new gender). If transgender people are not allowed to change their birth numbers or names during the sex change process, it will expose them to odd questions, she pointed out.
